FISH TRAP FARM — GREAT PYRENEES PUPPY SALES AGREEMENT
This agreement is entered into between Fish Trap Farm (“Seller”), located in Strawberry Plains, Tennessee, and the purchaser (“Buyer”), for the sale of one Great Pyrenees puppy. All buyers must review and sign this contract before taking possession of a puppy.
Terms & Conditions
1. Health Guarantee
Seller guarantees that the puppy is in good health at the time of sale and has received age-appropriate vaccinations and deworming. Buyer agrees to have the puppy examined by a licensed veterinarian within 72 hours of pickup. If a licensed veterinarian determines the puppy has a serious congenital health defect within this 72-hour window, Buyer may return the puppy for a replacement from a future litter at Seller’s discretion. The purchase price will not be refunded.
2. Genetic Health Guarantee
Seller provides a 24-month guarantee against hereditary conditions that significantly impair the dog’s quality of life, including hip dysplasia (OFA rating of severe) and other debilitating genetic conditions. If a licensed veterinarian diagnoses such a condition within 24 months of the date of birth, Seller will offer a replacement puppy from a future litter. Buyer must provide veterinary documentation. This guarantee does not cover conditions resulting from injury, neglect, improper nutrition, overfeeding, or excessive exercise during the growth period.
3. Spay/Neuter Requirement
This puppy is sold on AKC Limited Registration unless a full registration breeding agreement has been separately executed in writing. Buyer agrees to spay or neuter the puppy by 18 months of age unless otherwise agreed upon in writing. Buyer shall provide proof of spay/neuter to Seller. Failure to comply constitutes a breach of contract, and Seller reserves the right to reclaim the dog.
4. No Breeding Rights
Unless a separate written breeding agreement has been signed, Buyer agrees that this puppy shall not be bred. AKC Limited Registration restricts offspring from being registered. Any unauthorized breeding constitutes a material breach of this contract.
5. Care & Living Conditions
Buyer agrees to provide the puppy with adequate shelter, clean water, quality nutrition, regular veterinary care (including vaccinations, heartworm prevention, flea/tick prevention, and annual wellness exams), socialization, and humane treatment at all times. The dog shall never be kept in a kennel, crate, or confined space as its primary living arrangement. The dog shall never be chained or tethered as a primary means of containment.
6. No Rehoming Without Consent
Buyer agrees to never sell, give away, surrender to a shelter, or transfer ownership of this dog to any third party without first notifying Seller and offering Seller the right of first refusal. If at any time Buyer is unable to keep the dog, Seller must be contacted immediately. Seller will facilitate the dog’s return or appropriate rehoming.
7. Return Policy
If Buyer is unable to keep the dog at any point during the dog’s lifetime, Seller will accept the dog back. No refund will be issued for returned dogs.
8. Right of Reclamation
If Seller has reasonable evidence that the dog is being neglected, abused, kept in unsuitable conditions, or that any term of this contract has been violated, Seller reserves the right to reclaim the dog. No refund will be issued.
9. Breed Acknowledgments
Buyer acknowledges that Great Pyrenees are independent, strong-willed dogs that bark, roam, and dig as part of their natural guardian behavior. Buyer has researched the breed and understands its needs, including adequate space, secure fencing (minimum 5 feet), patience with training, and tolerance of nighttime barking. Buyer understands this breed is not suited to apartment living, small yards without fencing, or homes where the dog will be left alone for extended periods.
10. Limitation of Liability
Seller’s total liability under this agreement shall not exceed the purchase price of the puppy. Seller is not liable for any veterinary expenses, training costs, property damage, personal injury, or other consequential damages incurred by Buyer after the puppy leaves Seller’s premises.
11. Governing Law
This agreement shall be governed by the laws of the State of Tennessee. Any disputes shall be resolved in the courts of Knox County, Tennessee.
